In 2024, nearly half of US teenagers aged 1317 reported being online almost constantly, with TikTok being one of the most popular platforms.4 5 Despite TikToks community guidelines restricting access to alcohol, tobacco and drug content for users under 18 years,6 minors can still access content promoting nicotine products.7 With algorithmic features and retention techniques, for example, the For You page and infinite scrolling, platforms like TikTok offer powerful marketing tools for targeting specific audiences.8 Further, the international nature of social media enables content uploaded in countries with looser advertising regulations to reach young users in countries with stricter advertising laws, thereby undermining national regulations.911 This regulatory gap arises from TikToks failure to adequately self-enforce and conflicting cross-border advertising regulations

As recommended in Growing Up Tobacco Free (IOM 1994) the proposed Tobacco Control legislation would strengthen the required package warnings immediately and would confer authority on the FDA to revise these requirements upon finding that such a change would promote greater public understanding of the risks associated with tobacco.
